Model Of Web Of Causation Health And Social Care Essay
Model Of Web Of Causation Health And Social Care Essay The model of web of causation dates back to 1960, when it was developed to represent different pathways that point on a genesis of a health problem or a disease, giving rise to defined causative risk factors. The model has been used in community health and nursing to explain diseases and disabilities caused by multiple factors and identify possible points for preventive interventions in community health problems. This research paper introduces the conceptual nursing model of the web of causation and uses a community aggregate of children below 18 years diagnosed with type 1 and type 2 diabetes to discuss conceptual nursing web of causation. Introduction Medicineamigo (2007) defines web of causation as a medical term used to represent a complex group of subjects and relationships that can contribute to occurrence and spread of a disease. The model of web of causation shows that diseases are not distributed randomly in any group but isolation of how they are distributed requires one to study several factors. This implies that there are multiple and heterogeneous causes of any disease, symptom or health condition, collectively forming a web of causation. Clark (2008) argues that the model of the web of causation represents pathway factors that point to a genesis of a health problem and gives rise to or mitigate more precisely defined causative risk factors. Based on this model, one can increase the chances of controlling a disease or a health condition by breaking more links within the web of potential factors in the model. The model offers a solution in conceptualizing health problems that have multi- factoral etiologies such as diabe tes. Historical Development of Model of Web of Causation MacMahon, Pugh, and Ipsen (1960) came up with the model of web of causation; whereby it was used explain the occurrence of icterus for a group of patients who were receiving treatment for syphilis. This was followed by a more sophisticated but generalized web of causation that Stallones came up with in 1966. The purpose of his web of causation was to to describe the interrelationships among the 3 main types of cardiovascular disease. After some further research, Friedman developed a web of causation that was more detailed in 1980. His model was based on causation for the classic heart attack. This development marked the beginning for mapping what is today known concerning the etiology of heart diseases. The model of web of causation has continued to gain popularity since its discovery in 1960 and has proved useful in identifying possible factors for preventive interventions in community health. How Concepts Relate Within the Model of Web of Causation Duncan (2007) points out how the model of web of causation emphasizes on agents in explaining causes of diseases, while providing multifactoral causes that traverse various pathways, mirroring reality. In this model, the disease or a health condition is not only seen to be having different causes, but each one of these individual causes is viewed as a consequence that came from the multiple causes, of which each is an effect resultanting to multiple causes. This web is built using arrows of causation, with each arrow of causation implying that the element at the arrow source is somehow an individual cause of the element at that particular point of the arrow. Using type 1 and type 2 diabetes in children under 18 as an example, the disease can be as a result of new potential risk factor within the neighborhood or a variable in the web of causation representing a toxic environment that leads to diabetes or a variable representing lack of health care for possible underlying causes of dia betes such as high blood pressure or obesity, or having genetic predisposition that leads to diabetes (At Health 2005). Model Application to Nursing Process The model of web of causation can be used in nursing process to explain diseases and disabilities caused by multiple factors such as hepatitis and diabetes, which can be explained using complex relationship in the disease agent, host and environment; integrating factors such as genetic factors, environmental factors and race among others (At Health, 2005). American Diabetes Association (2000) highlights the importance of the model of web of causation in monitoring of diabetes in children and adolescents to avoid further complications resulting from the disease. This can be achieved when families work together with health care providers to help set a childà ¢Ã¢â ¬Ã¢â ¢s target for blood glucose levels and develop a personal diabetes plan for healthy meals, regular exercise and oral medication. Duncan (2007) explains how the model can be applied in nursing to address health related threats and conditions such as the problem of teenage pregnancy, which is attributed to complex interaction between several causative and contributing factors such as ignorance, peer pressure and lack of contraceptives among others. Applications Model of Web of Causation to Community Health Problems According to Clark (2008), the model of web of causation is applied in enhancing the understanding of non-communicable diseases. The model has further been used in identifying possible points for preventive interventions in community health problems. Based on this model, prevention of obesity can be used as an intervention measure to protect the target population from being infected with type 2 diabetes. Duncan (2007) explains the importance of the model of web of causation in summarizing community health information for presentation, communication and analysis. He points out the importance of the model in study of distribution of health outcomes in a given population through interpretation of epidemiological relationships. Importance Of Community Partnership In Community Health Projects Community partnership in community health projects brings collaborative efforts to improve health through sharing of resources, combining talents and enhancing opportunities to achieve positive health outcomes (World Health Organization, 2002). According to World Health Organization (2002), involving communities in community health projects is a sign of giving up control and concern about who contributes to success of the partnership. This empowers people to creatively develop skills and build competencies and capacities because better and more sustainable decisions are made by involving communities in decision making. Furthermore, community participation in health projects is a way of extending the democratic process by opening up governance and redressing inequality in power for organizations involved. This offers new opportunities for creative thinking and innovative planning of health projects. Partnership with community in community health project implementation creates dedicated staff in project implementation as communities positively identify with the projects. This ensures ownership and sustainability of the projects, provides a source of information, knowledge as well as experience and eliminates deficiencies in the society, while empowering members to put emphasis on problem solving (WHO, 2002). Conclusion The model of web of causation is an important model that has been used in community health to represent different pathways that point on a genesis of a health problem or a disease, giving rise to defined causative risk factors. It has proved to be a viable model in addressing health problems that have multifactoral causes like the type 1 and type 2 diabetes. Lasting solutions in addressing community health problems can be achieved by involving people at community level in decision making and participation in community health projects.

Back to the Future: Past, Present, and Future Essay
There is much to discuss and analyze about all three installments. These would include actor choices, spotting, direction, acting, and most importantly the soundtrack and musical choices for all 3. Considering all 3 movie plots jump from decade to decade, it can be analyzed literally from past, present, and future. Inevitably, Back to the Futureââ¬â¢s success also led to several video game launches, a ride at Universal Studios in Hollywood and Orlando, an animated series, and even a comic book. Letââ¬â¢s go back to the year 1985, you and your bodacious friends want to hang ten with the dudes, so you guys catch a flick at the local cineplex. Your choices are Mask, Teen Wolf, or Back to the Future. You mean the guy from Family Ties? So you take your chances on Back to the Future. Good choice! Of all things, Eric Stolz, the main actor in Mask, was originally cast for the role of Marty Mcfly when production of Back to the Future began on November 26,1984. Stoltz was filmed for four weeks, but after seeing a rough cut, Steven Spielberg and the writer/directors decided that Stoltz had played the role ââ¬Å"too seriouslyâ⬠for a comedy, and he was replaced by Michael J. Fox (Futurepedia). Back To The Future was written by Bob Gale and Robert Zemeckis, and mainly starred Michael J. Fox and Christopher Lloyd. The movie opened on July 3, 1985 and grossed $210 million at the US box office, making it the highest grossing film of 1985 (IMDb). The basic synopsis of Back to the Future 1, is about a young man named Marty Mcfly who accidentally travels into the past and jeopardizes his own future existence. With the help of an eccentric local scientist named Dr. Emmett L. Brown, he manages to travel back in time via a time machine made from a DeLorean. This was done by breaking the time barrier in what was called temporal displacement allowing it to travel along the space-time continuum. When the first script was made, a refrigerator was the planned prop for the time machine. Later Steven Spielberg decided he didnââ¬â¢t want kids trapped inside their refrigerators trying to play time traveling games (Funtrivia). Done carefully, Bones Howe (music supervisor) and Alan Silvestri (composer) gathered an array of perfectly fit songs to cater both the 1950ââ¬â¢s as well as the 1980ââ¬â¢s. The movie jumps from decade to decade throughout the movie, and makes it apparent when it does. The movie starts out when Marty is late for school, he gets on his skateboard and we hear a fantastic song by Huey Lewis and the News, the ââ¬Å"Power of Love. Later in the movie, we hear another solid track by Huey Lewis entitled ââ¬Å"Back in Time. â⬠By the way, Huey Lewis makes a cameo as a judge. When Marty tries out for the school competition, Huey says, ââ¬Å"hold it. hold itâ⬠¦ Iââ¬â¢m afraid you are just too darn loud. â⬠This is also considered diagetic mus ic in the film. Martyââ¬â¢s first time travel sent him to the year 1955. Marty, immediately, arrives at the Twin Pines Ranch, which was owned by Otis Peabody. Marty crashes into the barn on Mr. Peabodyââ¬â¢s property which causes the entire Peabody family to wake up and come outside. Marty encounters many differences between 1985 and 1955, including a cleaner, less run-down ambiance in the Courthouse Square. While searching for a younger Doc Brown, he meets his father and accidentally interferes with the first meeting of his parentsââ¬âbeing hit by his grandfatherââ¬â¢s Chevrolet in his fatherââ¬â¢s place. While in the 1950ââ¬â¢s, some of the songs we hear are such great classics ââ¬Å"Night Trainâ⬠by Marvin Berry, ââ¬Å"Earth Angel (Will You Be Mine)â⬠by Marvin Berry, ââ¬Å"Wallflowerâ⬠by Etta James, and ââ¬Å"Johnny B. Goodeâ⬠by Chuck Berry aka Marty Mcfly. Some people complained that Back to the Future was a racist movie because Chuck Berry was inspired by a white guy. Sometimes a joke is just a joke; but Chuck Berry liked it. (Davis). Finally we have the sensational score by Alan Silvestri. At times the score is adventurous, and at times itââ¬â¢s sad. The spotting is done just right to balance the dynamics of the movie. Also, there is a leitmotif that accompanies the movie, in fact, it accompanies all 3 movies of the trilogy, and never goes unnoticed. Upon the success of the first film, Robert Zemeckis (director) and Bob Gale (writer) agreed to do a 2nd movie. In fact, they also intended on a 3rd movie, and both the 2nd and 3rd Back to the Future were filmed simultaneously and released six months apart. Back to the Future 2, with a budget of $40 million, grossed nearly $331 million at the box office (IMDb). The characters of George Mcfly and Jennifer Parker were played by different actors from those in the first film, requiring scenes that overlap to be re-shot. Jennifer Parker which was originally played by Claudia Wells, and replaced by Elisabeth Shue in the second film. Claudia claims she turned the roll down when she found out her mother was diagnosed with cancer (Futurepedia). George Mcfly, who was originally played by the quirky Crispin Glover, was later replaced by Jeffrey Weissman. Crispin Glover refused to return to the trilogy due to salary disputes. Back to the Future 2 pans back and forth from 1955, to 1985, and all the way to 2015; the past, present and future. Needless to say, Bob Gale and Zemeckis attempted to predict what 2015 would like and sound like. Some songs used in the 2015 scenes, were ââ¬Å"Beat itâ⬠by Michael Jackson, ââ¬Å"I Canââ¬â¢t Drive 55â⬠by Sammy Hagar, ââ¬Å"Mr. Sandmanâ⬠by The Four Aces, and ââ¬Å"Papa Loves Mamboâ⬠by the Perry Como. The filmmakers did do some research into what scientists thought may occur in the year 2015. Bob Gale also commented; ââ¬Å"We knew we werenââ¬â¢t going have flying cars by the year 2015, but God we had to have those in our movie. ââ¬Å"(Q ;amp; A) The film was also considered one of the most ground-breaking projects for Industrial Light ;amp; Magic. It was one of the effects houseââ¬â¢s first forays into digital compositing, as well as the VistaGlide motion control camera system, which enabled them to shoot one of the filmââ¬â¢s most complex sequences, in which Michael J. Fox played three separate characters, all of whom interacted with each other. Although such scenes were not new, the VistaGlide allowed, for the first time, a completely dynamic scene in which camera movement could finally be incorporated. The technique was also used in scenes where Thomas F. Wilsonââ¬â¢s character (Biff Tannen) had to interact with a younger version of himself. (Zemeckis) Six months after Back to the Future 2 was released in the theaters, the Back to the Future team released Back to the Future 3 on May 25, 1990. Again on a budget of $40 million, this one cashed in at $244 Million. The film takes place immediately after the events of Back to the Future Part II. While stranded in 1955, Marty McFly discovers that his friend Dr. Emmett ââ¬Å"Docâ⬠Brown was killed by Biff Tannenââ¬â¢s great-grandfather Buford. Marty decides to travel to 1885 to rescue Doc and return to his own timeline. This time, Alan Silvestri had to create his soundtrack based in the year 1885. However, he still maintained the leitmotif throughout the picture. The years 1985 and 1955 are still relevant in the 3rd movie, and it jumps around. The popular group ZZ Top make an appearance, as they perform ââ¬Å"Doublebackâ⬠during a festival in 1885. This was also considered diagetic ââ¬â-performed for the actors and the audience to hear. Huey Lewisââ¬â¢ ââ¬Å"Power of Loveâ⬠is also heard again. In 1989, a video game, based on the original Back to the Future movie was produced for the 8-bit Nintendo Entertainment System (NES) by video game publisher LJN a subsidiary of Acclaim games. This has some similarity to the 1983 Atari video game E. T. where producers felt it would sell solely on brand association to the hit movie and the game designers were only given five weeks in order to produce a product to get it on the shelves for the 1982 Christmas shopping rush. Reviewers also cited that game as virtually unlike the film and was a major contributor to an economic downturn known as the Great Video Game Crash of 1983. There are only two songs found in the entire game. One is ââ¬Å"Johnny B. Goodeâ⬠which will play during the school dance that Marty is playing on stage and sounds close to the version heard in the film. The other song is a repetitive looping song that will play throughout the game in non-mini game moments. There are suggestions that the song is supposed to be ââ¬Å"The Power Of Loveâ⬠by Huey Lewis ;amp; The News sped up and cycled differently. But it winds up sounding nothing like the actual song made famous in the movie. Nes also later released Back to the Future 2 and 3 as a single game in 1990. Back to the Future II ;amp; III received largely negative reviews from critics. Stan Stepanic of Gamefreaks365. om gave the game positive remarks in regards to similarities with The Goonies II, but gave it a largely negative review due to the lack of a password or save feature coupled with its notorious length, although there was a code to skip to the second half of the game. Back to the Future II ;amp; IIIââ¬â¢s length has often been cited as the gameââ¬â¢s major weakness, Stan stating that it took him roughly six hours just to map it, and he spent so much time trying to fini sh it he actually turned it off out of boredom. (Gamefreaks). Sega Genesis also released their own version of Back to the Future 3 in 1991. It was a lot different than the Nintendo version. However, it was just as unpopular, the opening level was nearly impossible to complete. Finally in 2010, Telltale Games released Back to the Future on PC and Mac; and later was also released on the Ipad and Playstation 3. This was given way better reviews than the predecessors, and remains the best game of yet. Ben PerLee from GameZone summarized his praise of the game by saying it is a ââ¬Å"feel good cinematic experience that any fan of Back to the Future will want to check out, and everyone else would do well to check it out. GameZone) Back to the Future: The Animated Series was an animated series based on the Back to the Future trilogy as well. The series lasted two seasons, each lasting 13 episodes, and ran on CBS from September 7, 1991 to November 28, 1992, the date of the last original episode. Harvey Comics also published a series of Back to the Future comic books starting in November 1991. With the cover header reading â⬠Å"The Adventure Has Only Begun! ,â⬠the first issue featured Doc & Marty in 1927 Chicago. On May 2,1991 the Universal Studios Theme park in Florida released Back To The Future: The Ride. It was a simulator ride based on the popular movie trilogy of the same name. It was a mini-sequel to Back to the Future Part III. Later at Universal Studios Hollywood, they opened the same ride on June 12, 1993 ; and then at Universal Studios Japan on March 31, 2001. The Orlando and Hollywood versions closed in 2007 (Futurepedia). Although Back to the Future creators Robert Zemeckis and Bob Gale had no involvement with the ride, they were consulted as to whether they ââ¬Å"got Doc rightâ⬠. The two responded with a ââ¬Å"yesâ⬠. They have also commented that ââ¬Å"itââ¬â¢s a great ride. In addition, references are made to a ââ¬Å"Zemeckis-Gale diagramâ⬠and ââ¬Å"Gale-Zemeckis Coordinates (Giveneyestosee) With the huge success of the Back to the Future Trilogy, you can see where a simple idea can turn into a big one. When you take risks on a new actor, and stamp something with a touch of great directing, production, and a great score ââ¬â- you never know what could happen. Back to the Future will always remain a classic no matter what generation it leads to; whether it be 1955,1985, or even 2015. Works Cited ââ¬Å"Back to the Future II & III Review. Review. Zimbabwe and South Africa - 2491 Words
In the recent years, China has had a growing presence in the African continent, engaging in trades, delivering aid and initiating projects. Chinaââ¬â¢s involvement in Africa is something that has triggered very animated debates among students and scholars. Many hypotheses as to Chinaââ¬â¢s intentions have been presented. Is China really the solution to Africaââ¬â¢s underdevelopment or simply for its own political and economical interests? This essay will present a more pessimistic view on this whole situation arguing the very dangers and consequences of Chinaââ¬â¢s relationship with Africa. Nonetheless, several experts have condemne d the Chinese government for fueling the ongoing conflicts in Zimbabwe and for helping the authoritarian government in its repression of any opposition. China has been heavily criticized for shipping armament to Zimbabwe that would ultimately distributed to the military and the militia that would help keep the opposition down during the 2008 elections. Although China adopts its non-interference stance, such types of trades are ultimately affecting the country. The delivery of those arms coincided with a time of extreme hostilities in the country and many pointed fingers at the Chinese government for blatant human rights violations (Spiegel and Le Billon 324, 330). Longfellows The Rainy Day
Children across New England are familiar with the works of Henry Wadsworth Longfellow, whose Paul Reveres Ride has been recited at many a grade school pageant. Longfellow, born in Maine in 1807, became an epic poet of sorts for American history, writing about the American Revolution in the way bards of old wrote about conquests across Europe. The Life of Longfellow Longfellow the second-oldest in a family of eight children, was a teacher at Bowdoin College in Maine, and later at Harvard University. Longfellows first wife Mary died in 1831 following a miscarriage, while they were traveling in Europe. The couple had been married for only four years. He did not write for several years following her death, but she inspired his poem Footsteps of Angels. In 1843, after years of trying to win her over for nearly a decade, Longfellow married his second wife Frances. The two had six children together. During their courtship, Longfellow often walked from his home in Cambridge, crossing the Charles River, to Frances family home in Boston. The bridge he crossed during those walks is now officially known as the Longfellow Bridge. But his second marriage ended in tragedy as well; in 1861 Frances died of burns she suffered after her dress caught fire. Longfellow was himself burned trying to save herà and grew his famous beard to cover the scars left behind on his face. He died in 1882, a month after people around the country celebrated his 75th birthday. Body of Work Longfellows best-known works include epic poems such as The Song of Hiawatha, and Evangeline, and poetry collections such as Tales of a Wayside Inn. He also wrote well-known ballad-style poems such as The Wreck of the Hesperus, and Endymion. He was the first American writer to translate Dantes Divine Comedy.à Longfellows admirers included President Abraham Lincoln, and fellow writers Charles Dickens and Walt Whitman. Analysis of The Rainy Day This 1842 poem has the famous line Into each life some rain must fall, meaning that everyone will experience difficulty and heartache at some point. The day is a metaphor for life. Written after the death of his first wife and before he married his second wife, The Rainy Day has been interpreted as a deeply personal look into Longfellows psyche and state of mind. Here is the complete text of Henry Wadsworth Longfellows The Rainy Day. The day is cold, and dark, and dreary; It rains, and the wind is never weary; The vine still clings to the moldering wall,But at every gust the dead leaves fall,And the day is dark and dreary. My life is cold, and dark, and dreary; It rains, and the wind is never weary; My thoughts still cling to the moldering Past,But the hopes of youth fall thick in the blastAnd the days are dark and dreary.Be still, sad heart! and cease repining;Behind the clouds is the sun still shining;Thy fate is the common fate of all,Into each life some rain must fall,Some days must be dark and dreary.

Disenchantment and Modernity Essay - 1805 Words
The early twentieth century represented a turbulent and changing time, socially and in respect to art, for the majority of the western world. Specifically, during and Post World War I the art culture was radically morphing into a completely polar form. As artists utilized new methods and represented emerging movements such Expressionism, Cubism, Futurism, ââ¬Å"suprematismâ⬠, The Readymade, Dada, and Surrealism they all relied in the same belief of rebellion. This rebellion varied depending upon the artist and their interpretation but in all cases it served the same purpose ââ¬â to enlighten and redefine what art ââ¬Å"should beâ⬠and what can be called art. This disenchantment away from the stereotypical classic definitions of art and what isâ⬠¦show more contentâ⬠¦Additionally, these strokes are representative of the Art Nouveau movement of the early 19th century, often seen in relative architecture of the era. From historical research, the emotions that are expressed in the piece can be related to Munchââ¬â¢s life. Throughout his life, he was surrounded with death and disease as also represented in his earlier pieces where he repeatedly composes an image of a sick young girl in various mediums. His mother, father, and two siblings all had died of illness and had left Munch with feelings of despair and separation. These two themes are directly reflected in The Scream, as the solitary figure is left alone in foreground and is clearly anguished with the situation at hand. Further, the piece portrays an alternate connection to the existing technological advances of the era. It can be interpreted as a piece that is commenting on how Munch, and others, are being left behind in a world that is becoming ever more fascinated with technology and its industrialization. Representative of the Expressionist movement in Germany at the time, it put further emphasis on the emotions of the piece through explicit depiction and use of the vibrant colors as well as sense of intense unâ⬠easiness. Table of Contents Introduction2 Proceedings2 The evidence3 Precedents set by tribunals6 Conclusion6 Corporate Business Law Introduction An Employment Tribunal would hear claims regarding matters to do with employment. These could include unfair dismissal, discrimination and redundancy payments. An employment tribunal is similar to a court but it is not as formal and it must act independently. We will write a custom essay sample on Corporate and Business Law Assignment 2012 or any similar topic only for you Order Now These are commonly open to the public. Employment tribunals are independent judicial bodies who help determine disputes between employees and employers about their employment rights. The tribunal I chose to view and write this report on is an employment tribunal, that involved the claimant putting forward a case of unfair dismissal and breach of contract that was based on the fact that she felt she was unfairly dismissed while carrying out her duties that were set to her by her employer (Dr Monoghon). * Less formal than other court proceedings. * Lower costs. * Benefit of tribunal is they can choose to represent themselves. * Lay members specialise in their area of expertise regarding the case. Below are details of the claimant, defendant, time, date and venue. The Case Unfair Dismissal and breach of contract Venue: Croydon Tribunals Date: 13th November 2012 Time: 10:00am ââ¬â 16:00pm Defendant: Dr Hester Monoghan Claimant: Ms Davidson Evidence: 8 minutes Audio recording After Ms Davidson was dismissed from her job, she later received a call from the nanny agency that she was working for, stating that they had been informed by the police that of an allegation of child abuse by herself on the children. She was then refused to be represented by the agency as they did not want to put forward her name as it would reflect badly on the agency as she had a case on going against her. This prevented her from finding work and therefore was out of work for a period of five months. Ms Davidson opened this case up against the defendant as she feels she unfairly dismissed and had a bad reputation in regards to her occupation. She therefore wanted to be reimbursed for the loss of the work she missed out on and also wanted to clear her name regarding this issue. Proceedings Upon entering the tribunal room, the judge was seated front centred facing both parties involved in the case, the parties involved were Miss Davidson the claimant, her representative Peter Mathews, seated next to her and parallel to her on the left hand side were the respondents Dr Monoghan and Mr Monoghan. Once entered the judge introduced her and then allowed the defendant and claimant a chance to introduce themselves, preceded by giving defendant an opportunity to provide a brief history of the events which had taken place. Dr Monoghan believed that the claimant had not been fulfilling her duties properly and was in breach of the employment contract as it had come to the Monoghans attention that she was using foul words in front of her children, which the children had picked up and started to use whilst in the home environment. Dr and Mr Monoghan did not approve of this and believed that the claimant had been lying about taking her kids to activities and used to say she did in the diary that had been prescribed to the claimant. For this reason she felt she had to take the situation in to her own hand and therefore had her husband put in place voice recording measures in an open plan kitchen/living/dining room. On 8th March 2012 they made an eight hour recording of Ms Davidsonââ¬â¢s shift at her house. This was broken in to segments totalling a twenty minute recroding. After listening to the audio recording they felt that they had ââ¬Å"reasonable grounds to believe that Miss Davidson was verbally abusive and showed a lack of empathy and lovingness towards her children. The evidence The judge then gave Dr Monoghan a chance to play the evidence that had been produced but Mr Monoghan then intervened and then asked the judge ââ¬Å"Is it not against privacy right to play a recording in a public tribunalâ⬠. The judge then referred to a ruling book and then she made a judgment that it would be allowed as she felt it corresponded to the guidelines of the tribunal proceedings. Mr Monoghan then setup the audio to show the recording that was made on the 8th March 2012 whilst his children were in care of Ms Davidson. I felt this expression was used for the fact that it was a public viewing and Mr Monoghan felt it was a sensitive situation as it involved his children of a minor age which could be seen as a private matter to him and his family as he would not want his kids further involved in this situation. The audio recording was of snippets of dinner time while the children were in care of Ms Davidson. The children were not paying attention to what Ms Davidson was telling them to do and therefore this was frustrating her. Her mannerism towards the children then indicated that she was persistent for the children eating their food also indicating threatening behaviour indicated the comment by ââ¬Å"if you donââ¬â¢t eat your food the trolls are going get youâ⬠. There were words used such as; ââ¬Å"Go awayâ⬠ââ¬Å"Shut upâ⬠ââ¬Å"Can you just eat your food!! â⬠ââ¬Å"Stop itâ⬠There was a constant rudeness to the children throughout this recording. The male child was especially picked on by Ms Davidson as she would say to him ââ¬Å"You, stop being bossy to your sister! During the recording there was a clear sharpness to Ms Davidsonââ¬â¢s voice towards the children and there was a continuity of abusive behaviour towards the children. Questioning of Dr. Monoghan Once this audio recording was finished the judge then asked the defendant, Dr Monoghan, to come up on the witness stand. Dr Monoghan was then asked to read out the Oath of Truth in court. The judge then began to ask her questions to break it down and try and work out really what happened. You read "Corporate and Business Law Assignment 2012" in category "Essay examples" Talking about the appraisal meeting in January defendant explained that she had raised the fact that the children had been using inappropriate language to her and her husband such has ââ¬Å"shut upâ⬠and ââ¬Å"thatââ¬â¢s toughâ⬠. She then went on to say that she had highlighted this to Ms Davidson and asked her to restrain from using these words in front of them as felt it would have a negative impact on their upbringing. She also asked Ms Davidson to focus on the male child as she felt her relationship with the female child was a good one. To this Ms Davidson replied by saying that the male child was the most difficult child she has ever looked after. To this the defendant replied that this meeting had been set up simply to raise their concerns but were given no reassurance by Ms Davidson stating that these problems would be sorted. They informed her of the fact that they had a recording and asked her if she would like to hear it but Ms Davidson said she could not do this as she had a job interview to go to as she was going to become redundant within the next month and Mr Monoghan had been made redundant from his job and was therefore going to take control of the child care himself. Dr. Monoghan then stated they both left the room and decided between themselves that they were not happy for the claimant to continue her job and therefore dismissed her there and then. Questioning of Mr Monoghan Mr Monoghan stated that he raised concerns and for this reason he was not happy for Miss Davidson to continue looking after his children as he was concerned about the safety of his children. He then stated that he offered to play the recording to Ms Davidson but she refused as she had an interview to attend as she was coming to the end of a contract. This was due to Mr Monoghan becoming redundant from his job and therefore taking control of his childrenââ¬â¢s wellbeing. Questioning of Ms Davidson Ms Davidson confirmed that the transcript of the meeting was correct. She then went on to say that she felt that she was not prepared for the meeting and felt as if she had the right to have an independent witness with her. She then went on to say that she had only said ââ¬Å"Shut upâ⬠to the children once and it was unfortunate that she had been caught out on that one instance. She did admit to wrongfully doing by using this phrase towards the children. She was angered with the fact that she was told it was a reference and holiday pay meeting but turned out to be her last day of work. The final verdict The judge felt that as Ms Davidson had been out of work for three months due to the allegations that were made to the police that she should be compensated three months wages. The judge then ordered the defendants to pay Ms Davidson for the two weeksââ¬â¢ notice that she should have had. She dismissed any allegations of MS Davidson physically abusing the children as there was no evidence found and advised the defendants to go through the police if they still felt this was a serious issue and also added that no further action would be taken within the tribunal system. Achievement of tribunal proceedings Speed Although the defendant arrived one hour late it still allowed the case to be completed within five hours. From the case I visited I soon realised there was a very productive speed throughout. The case I visited was scheduled for 1 day but was wrapped up within 5 hours and that included a 1 hour lunch, evidence, questioning and the judgment to take place. . There was not much waiting around and the whole case was to the point as through Expertise The judge who was appointed to the case for unfair dismissal was a specialist in this area she specialised in. Off the record the judge mentioned to us that this particular case was a difficult one as it involved one employee and one employer which meant she was dealing with a delicate situation. This was due to it involving children of a minor age and there had clearly been strong relationship between the family and Ms Davidson as it was previously stated in the appraisal meeting which clearly documented Ms Davidson as having a ââ¬Å"loving and caring relationshipâ⬠with her children. The judge began by introducing herself and unfortunately she did not have anyone else along with her judging the case so. There was an instance when Mr Monoghan raised an issue of the audio recording being heard while we were present as it children of a minor age talking on it throughout and after consulting a book for a few minutes she then came to a decision that it would not be a problem for this to be played out load while the public was present. Accessibility There are different mediums in which the claimant can use to put forward a case. The most commonly one used is usually the ET1 form, requiring the claimant to state the details of the case which they wish to put forward outlining the circumstances and any other issues regarding the case. However there are other formalities that can be used such as contacting the authorities through email or telephone. The accessibility of the case falls upon the representative to send through the relevant forms in order for the case to be reviewed and considered for a tribunal hearing. Fairness From what I witnessed at the tribunal case I felt that Dr. Monoghan and Mr Monoghan were unfairly judged by the judge as by the evidence that was heard it was clear to see that Miss Davidson was clearly not exercising her job efficiently enough as she was clearly heard using foul language in front of the children and I do believe she should of controlled her temper as this is what she was trained to do. I felt she Miss Davidson won the case based technicality as she was able to say she wasnââ¬â¢t directing her language towards the children and as of this was able to bypass the system and win the case. The judge should have shown more compassion towards Dr. Monoghan and Mr Monoghan as it was a case that applied to their children and therefor was a sensitive one for them as it could affect the children on the long term. Precedents set by tribunals The lower tribunals are not there to set binding precedents for any other court or even themselves. They are bound by the decisions of superior courts and appellate tribunals. Appellate and Employment appeal tribunals are bound by the decisions that are made by the Supreme Court but they would usually be required to being bound to the decisions that they made themselves (English legal systems, Richard Ward and Amanda Akhtar 11th edition). In regards to employment appeal tribunals, matters of law are binding on decisions of appeals and the House of Lords, although decisions of the high court in England and wales would usually have a great persuasiveness and the ribunals would similarly go with the principles that can be found in those decisions. There are certain precedents rules and guidelines that have been set out by previous legal cases and these have to be followed by tribunals. This allows there to be more of efficiency throughout the case as the defendants can refer back to the case that is in conjunction with the case however within the judicial system of a tribunal court there is a leniency and flexibility based on the case this was as well as the evidence and information provided by both parties. Taking this information into consideration the laments will then deliberate and make their decisions. Similar cases may have different outcomes which will not be based on the same precedents. Tribunals such as an employment based cases are required to follow certain procedures and take in to consideration such as reasons for dismissal with the notice given for dismissal and other externalities that are relevant to the case for dismissal. Main issue The main issue with tribunals setting binding precedents for other courts and themselves is that in tribunals there is a sense of flexibility in their operations and the judges and the courts use their interpretation of the situation to make a judgement and it would be optimistic to think that the doctrine of the binding precedents achieves the certainty and flexibility. Conclusion The judgement of the case went in favour of the claimant in the tribunal. I feel this is an unfair judgement as the parents had intrusted the claimant in taking care of their children in an appropriate manner but it was clear throughout the audio that was played that was not applied by the claimant and there was a constant rudeness and aggressiveness towards the children. I feel that as the claimant would have been a trained with the necessary skills to look after the children she should have still been able to detach her emotions from her actual duties towards the children as she is trained in this profession.
